YASHIL MEROS SERVICE USER AGREEMENT

TERMS AND DEFINITIONS

Operator - Payment institution “CLICK” Joint-Stock Company, a legal person registered in accordance with the legislation of the Republic of Uzbekistan (TIN: 302134733), located at: 35A, Salar Buyi str., Darkhan MCG, Tashkent city, Republic of Uzbekistan, and operating as the payment institution based on the license No. 1 issued by the Central Bank of the Republic of Uzbekistan dated 22.06.2024.

Mobile App Click SuperApp (hereinafter the Mobile App) - hardware and software complex, software solution in form of application for mobile devices, owned by the Operator, through which users can use the Operator’s services.

Yashil Meros Service (hereinafter the Service) - features provided by the Operator within the Mobile App, aimed at promotion of environmental protection and support of environmental initiatives. The Service operates only in a digital environment within the Mobile App interface and does not provide users with material values or financial rewards.

Users - capable individuals registered in the Mobile App, including those who gain access to the features of the Mobile App and use the services of the Operator.

Ecopoints are digital incentive units provided to Users within the Service for completion of the stipulated conditions and actions determined by the Operator. Ecopoints are not cash funds, digital money, securities or other means of payment. Ecopoints may not be exchanged for cash, transferred to third parties or used outside the features of the Service. Accumulated Ecopoints can be used only within the Service and do not create any property rights or obligations for the User. 

1. GENERAL PROVISIONS

1.1. In order to promote environmental protection and facilitate greening activities, the Operator offers the users of the Mobile App the opportunity to use the Service, which includes elements of gamification and is aimed at drawing attention to environmental issues in the Republic of Uzbekistan.

1.2. This Service User Agreement (hereinafter referred to as the “Agreement”) has been developed in accordance with Article 367 and Article 369 of the Civil Code of the Republic of Uzbekistan, is a public offer and defines the terms of use of the Service.

1.3. The use of the Service is not a lottery or other risk-based game, no fee is charged for use of the Service, and the participants of the Promotion do not bear any property risks in connection with the use of the Service.

1.4. The Service is a promotional event aimed at raising of awareness of environmental initiatives and motivating users to participate in greening activities in the Republic of Uzbekistan. 

2. TERMS OF SERVISE USE

2.3. To access the Service, the User must complete the following actions:

– go to the Service in the Mobile App;

– press the “Participate” icon;

By performing the above actions, the User confirms that he/she has read, as well as fully and unconditionally agrees (accepts) the terms of this Agreement, and also becomes a user of the Service.

2.4. To continue using the Service, the User must perform the following actions:

– to accumulate ecopoints in accordance with the mechanisms provided in the Service interface;

– to use accumulated ecopoints when a certain amount is reached for planting and subsequent cultivation of virtual trees;

– when a virtual tree reaches a certain level of growth, it is not subject to the growing process.

2.5. When the maximum height of the virtual tree is reached, the User must select the region of the Republic of Uzbekistan where the real tree will be planted. Being selection, the tree is transferred to the Tree List (a section of the Service that reflects the number of trees, their planting status, planting region, etc.), where the User can track the status of the tree and its planting.

2.6. The Service using process is specified in Appendix No. 1 to the Agreement.

3. OTHER TERMS

3.1. The User’s virtual trees are not objects of civil rights and do not have property value. They are used specifically within the Service interfaces for the purpose of using the Service and may not be transferred, sold, exchanged or used outside the Service by the User.

3.2. The Operator reserves the right to unilaterally at any time, without consent and without prior notice to users or other persons, make changes and/or additions to the Agreement or terminate/suspend/cancel the use of the Service by posting relevant information in the Mobile App and/or on other resources (on social network pages, etc.).

3.3. In case of violation of the Agreement, the Operator has the right to unilaterally restrict or terminate the User’s access to the Service. Thereat, the Operator has the right not to comment on its actions in relation to the specified User(s).

3.4. The User has the right to refuse to use the Service at any time by contacting the Operator.

3.5. The Operator shall not be liable for failure to fulfill or improper fulfillment of obligations due to failures in telecommunications and energy networks, effects of malicious programs, as well as unfair actions of third parties aimed at unauthorized access and (or) disabling the Operator’s software and (or) hardware complex.

3.6. The Operator has the right to unilaterally terminate or suspend the use of the Service or remove individual Users if for any reason the Service or any part thereof cannot be implemented as planned due to infection by computer viruses, defects, manipulation, unauthorized intervention, falsification, technical problems or any reason determined by the Operator that distorts or affects the performance, security, fairness, integrity of the use of the Service.

3.7. All conditions relating to the Agreement are governed by the current legislation of the Republic of Uzbekistan. 

4. FINAL PROVISIONS

4.1. Agreement is executed in Russian language, remain in force indefinitely and comes into force from date of acceptance by the User.

4.2. The Operator has the right to introduce changes and additions to the Agreement. Changes are published in the mobile app and come into force from the moment of publication. The User is obliged to independently trace the current version of the Agreement.

4.3. In case of disputes, the Parties shall strive to settle them through negotiations. If the dispute cannot be settled, it shall be resolved in court in accordance with the laws of the Republic of Uzbekistan.

Appendix No. 1

to Yashil Meros Service User Agreement 

PROCESS OF SERVISE USE

1. The User having sufficient number of ecopoints, plants a virtual tree seed;
2. The User having sufficient number of ecopoints, waters the seed and then the sprout of a virtual tree.
3. The User can water the virtual tree at a certain time interval specified in the Service interface;
4. Being regularly watered the virtual tree grows and acquires a new achievement;
5. Upon reaching the last level, the User can plant a tree by specifying the provided region as desired;
6. When a region is select, the tree is moved to the list of trees and its status is displayed in the Service interface;
7. The process of a tree growing starts over again.
